In response to this complex reality, the Fiscalía General de la Nación embarked on a transformative path, adopting a novel investigative methodology: context analysis. This approach seeks to move beyond viewing criminal acts as isolated incidents, instead understanding them as manifestations of organized criminal activity operating within a broader, systemic framework.

This methodology, however, is not native to domestic criminal law. Its roots lie firmly in international criminal law and international human rights law, where the concept of context has evolved to help establish state responsibility for human rights violations or to understand macro-criminality. The critical question then arises: what are the implications of transplanting such a powerful, yet distinct, tool from the international arena into the delicate machinery of internal criminal investigation? Can it fulfill its intended purpose without compromising the fundamental rights and established principles that underpin domestic justice?

At its heart, the analysis of context aims to provide a more effective means of investigating complex criminal phenomena, such as systematic crimes, organized crime, and macro-criminality. It offers a framework for investigators to trace reasonable lines of inquiry, uncovering patterns and structures that traditional, individualistic investigative methods might miss. Yet, the journey of context analysis from international to domestic law is fraught with significant challenges. In the realm of international human rights, for instance, courts like the Inter-American Court of Human Rights may leverage contextual evidence with a degree of flexibility in evidentiary principles to establish state responsibility, prioritizing the rights to truth and justice for victims. This contrasts sharply with the strictures of domestic criminal law, where the focus is on individual criminal culpability and where fundamental guarantees, such as the presumption of innocence and due process, are paramount.

The core critique centers on this fundamental divergence: while context analysis proves invaluable as a heuristic tool, guiding investigators and illuminating the broader landscape of criminality, it cannot legitimately serve as a substitute for concrete evidence required to attribute individual criminal responsibility. To allow context to overcome the presumption of innocence in a domestic court would undermine the very foundations of a fair trial. There are inherent normative deficiencies and theoretical problems that arise when applying a methodology designed for collective responsibility to the individual accountability demanded by domestic criminal law. The challenge lies in ensuring that this powerful investigative tool is integrated in a manner fully compatible with constitutional mandates and the inviolable rights of both the accused and the victims, preventing any erosion of the principles that safeguard a just legal process.
