Kwalifikacja prawna umowy faktoringu studium prawnoporównawcze

Robert Siwik's "Kwalifikacja prawna umowy faktoringu: Studium prawnoporównawcze" addresses the complex legal classification of factoring agreements, an instrument that remains ambiguously defined within Polish civil law and various foreign legal systems. This monograph offers a dogmatic analysis of factoring's legal structure under the Polish Civil Code, enriched by a comparative legal perspective, to clarify whether it constitutes an unnamed agreement, a mixed contract, or a distinct set of agreements.

The work provides essential insights into resolving the legal uncertainties surrounding factoring, a dynamically evolving segment of the financial market. By establishing the appropriate legal regime for these agreements, the book contributes to greater legal certainty and security in commercial transactions, offering a foundational understanding for legal professionals and scholars navigating this critical area of financial law.
